A guide to the legal and regulatory framework governing imports and exports through Kenya.
Compliance Framework
Kenya's import and export trade is governed by a robust legal framework. Kenwad Holdings Limited operates in full compliance with all applicable laws — and we keep our clients informed so they can trade with confidence.
The East African Community Customs Management Act (EACCMA) 2004 is the primary legislation governing customs in Kenya. It defines import/export procedures, duty assessment, customs offences, and the powers of customs officers. All clearing agents operate under this Act.
KRA Reference →Kenya's single-window trade facilitation platform — the mandatory electronic system for lodging customs declarations, pre-arrival documentation, and obtaining release orders. All KHL customs entries are processed through TradeNet for faster, transparent clearance.
TradeNet Portal →The EAC Common External Tariff determines the duties applicable on goods imported into the EAC customs territory. Kenya applies 0%, 10%, and 25% duty rates for raw materials, intermediate goods, and finished products respectively — with specific exceptions and exemptions.
All imports into Kenya above USD 2,000 in value require an Import Declaration Form, lodged through Kenya TradeNet. The IDF attracts a fee of 2.25% of the customs value. Kenwad processes IDF applications on behalf of clients as part of our standard service.
KEBS mandates that regulated products be inspected at origin before shipment to Kenya. Products covered by KEBS standards require a Certificate of Conformity from a KEBS-accredited inspection agent in the country of export. We advise on PVoC requirements for your specific cargo.
KEBS Website →VAT at 16% is charged on most imported goods in Kenya, calculated on the customs value plus customs duty. Certain goods are zero-rated or exempt. We calculate the full landed cost including VAT and customs duty in all our quotations.
